3. Eligibility

By using LandinChat, you represent and warrant that:

You agree NOT to use LandinChat for:

  • Fraudulent, deceptive, or misleading communications

  • Phishing or impersonation

  • Distribution of malware or malicious content

  • Violating WhatsApp, Meta, or third-party platform policies

  • Harassment, abuse, or unlawful communication

  • Sending prohibited or restricted content

  • Violating data protection or privacy laws

Users are solely responsible for the content, contacts, campaigns, and communications sent through the platform.

6. WhatsApp & Third-Party Compliance

LandinChat is not affiliated with or endorsed by WhatsApp LLC or Meta Platforms, Inc., unless explicitly stated.

Users are fully responsible for ensuring compliance with:

  • WhatsApp Business Policies

  • Meta Platform Policies

  • Anti-spam regulations

  • GDPR

  • CAN-SPAM laws

  • Local data protection regulations

Violation of third-party policies may result in:

  • Account suspension

  • Messaging restrictions

  • Number bans

  • Service termination

We are not liable for actions taken by WhatsApp, Meta, telecom providers, or third-party platforms.

7. Payments & Billing

Certain features require paid subscriptions.

By purchasing a subscription, you agree:

  • To provide accurate payment information

  • To pay all applicable fees and taxes

  • That subscriptions may renew automatically unless canceled

Failure to make payment may result in suspension or termination of access.

Pricing may change at any time. Existing users may be notified before significant pricing updates.

8. Refund Policy

Unless otherwise stated in writing:

  • Payments are non-refundable

  • Partial usage periods are non-refundable

  • Setup fees and onboarding fees are non-refundable

Refunds may be considered only in exceptional cases at our sole discretion.

Chargebacks or payment disputes initiated without contacting support may lead to permanent account suspension.

9. Intellectual Property

All platform content, branding, software, designs, logos, text, graphics, APIs, and systems are the property of SaaS Solutions, LLC or its licensors.

Users may not:

  • Copy or resell the platform

  • Reverse engineer the software

  • Reproduce proprietary systems

  • Use branding without permission

  • Create derivative products based on LandinChat

Unauthorized use may result in legal action.

10. API & Automation Usage

If API access is provided:

  • You must not abuse API limits

  • You may not attempt unauthorized access

  • Excessive requests may result in throttling or suspension

  • We may change API functionality without notice

Automation features must be used responsibly and in compliance with platform policies.

11. Data & Privacy

We may collect and process user data as described in our Privacy Policy.

By using LandinChat, you consent to the collection and processing of data necessary to provide the services.

Users are responsible for obtaining lawful consent from their contacts before sending communications.

12. Service Availability

We do not guarantee uninterrupted or error-free service.

Downtime may occur due to:

  • Maintenance

  • Server issues

  • Third-party outages

  • Internet disruptions

  • Platform limitations

We are not liable for losses caused by interruptions, delays, or service unavailability.

13. Limitation of Liability

To the maximum extent permitted by law, SaaS Solutions, LLC and LandinChat shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits

  • Data loss

  • Business interruption

  • Account bans or restrictions

  • Third-party platform actions

  • Losses resulting from misuse of the platform

Our total liability shall not exceed the amount paid by the user during the previous 30 days.

14. Indemnification

You agree to indemnify and hold harmless SaaS Solutions, LLC, its affiliates, employees, partners, and licensors from any claims, liabilities, damages, or expenses arising from:

  • Your use of the platform

  • Violation of these Terms

  • Violation of laws or third-party rights

  • Content or campaigns sent through your account

15. Account Suspension & Termination

We reserve the right to suspend or terminate access without prior notice if:

  • These Terms are violated

  • Abuse or suspicious activity is detected

  • Spam complaints occur

  • Legal or compliance risks arise

Termination may result in permanent deletion of account data.

16. Third-Party Services

LandinChat may integrate with third-party platforms and services.

We are not responsible for:

  • Third-party outages

  • External integrations

  • Changes in third-party APIs

  • Third-party terms or policies

Use of third-party services is subject to their own terms.

17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Montana, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the appropriate courts located in Montana, USA.

We may update or modify these Terms at any time.

Updated versions will be posted on this page with a revised effective date.

Continued use of the platform after updates constitutes acceptance of the revised Terms.
